Terms and conditions of the instagram competition called "Floor mat tests"

§1 General provisions

  1. The organiser of the Competition is Sox Box Mateusz Jagodziński ul Drawska 10, 02-202 Warsaw NIP 7010973452.
  2. The Competition is conducted according to the rules described in these Terms and Conditions, in compliance with the generally applicable provisions of Polish law. 
  3. The competition starts on 9.05.2024 and ends on 13.05.2024 at 23:59:59 Polish time. 

§2 Participants and rules of the Competition

  1. Participation in the Competition is voluntary and free of charge.
  2. The Competition is open to a natural person (a consumer as defined by Article 22 of the Civil Code), hereinafter referred to as an Entrant, who:
    • has read and accepted these Rules and has consented to the processing of personal data for the purposes of the Competition by entering the Competition; 
    • have reached the age of 18 and have full legal capacity;
    • having an address for service in the territory of the Republic of Poland, 
    • has a public account (profile) on Instagram, 
    • will perform the Competition Task. 
  3. Only a person meeting the conditions specified in §2. point 2 of the Regulations may be a Participant of the Competition.
  4. Employees of the Organiser and entities and employees of entities providing services to the Organiser in organising the Competition on the basis of civil law contracts, as well as members of the immediate family (spouses, ascendants, descendants and siblings) of the above persons are excluded from participation in the Competition.
  5. In order to participate in the Contest, during the Contest, the Entrant will perform the Contest Task of adding a comment with the answer to the Contest question: What ideas do you have for an additional use of the Antilda floor mat? (hereinafter: the Competition Task). 
  6. Completion of the Contest Task means posting on Instagram by the Contest Participant at URL: www.instagram.com/antidla_accessories a comment which is an answer to the question §2 point 6.
  7. The Competition will only be open to Participants who complete the Competition Task during the Competition period. 
  8. The Organiser reserves the right to remove and not include in the Competition the completed Competition Tasks whose authors:  
    (a) do not act on their own behalf but through third parties,
    (b) operate from fictitious accounts/profiles on Instagram;
    (c) create fictitious accounts/profiles on Instagram;
    (d) violate the Instagram terms of service.
    e) used, in the Competition Task, words commonly regarded as offensive, pornographic content, content advocating racial, ethnic and religious hatred or discriminating against social groups, or violated the personal interests of third parties or the Organiser.

§3 Rights to the completed Competition Tasks

  1. The Entrant warrants that the completed Competition Task will not infringe any rights or property of the Organiser, individuals or third parties, in particular their property and personal copyrights and personal rights. 
  2. The Entrant declares that he/she is entitled to exclusive and unlimited copyright to the Competition Task he/she has created, and that the Competition Task he/she has created is not encumbered with any rights of third parties, and that the work has not been published before. 
  3. Pursuant to Art. 921 § 3 of the Civil Code, upon the release of the Prize, the Organiser reserves the right to acquire a non-exclusive licence to the Competition Task awarded in the Competition without any time and territorial restrictions, and the awarded Competition Participant (Winner) grants the Organiser a non-exclusive licence to the awarded Competition Task in the following fields of exploitation:
    • for the recording and reproduction of the work - production of copies of the work by a specified technique, including printing, reprography, magnetic recording and digital technology
    • within the scope of trading in the original or copies on which the work has been fixed - marketing, lending or leasing the original or copies;
    • within the scope of dissemination of a work in a manner other than specified in point b - public performance, exhibition, display, reproduction, as well as broadcasting and re-broadcasting, as well as making a work available to the public in such a way that everyone can have access to it at a place and time individually chosen by them, including introducing a work into computer memory and into telecommunication and IT networks.

§4 Prizes and Determination of Winners 

  1. To ensure the proper conduct of the Competition, the Organiser will appoint a two-person commission, hereinafter referred to as the Competition Commission. The tasks of the Competition Committee shall include overseeing the proper course of the Competition, deciding on all matters pertaining to the Competition, including the interpretation of these Rules, and selecting the Participants to whom the Prizes shall be awarded (hereinafter referred to as the Winners). The decisions of the Committee shall be final, which shall not deprive the Participant of the right to pursue claims under the law.
  2. At the end of the Competition, the Competition Committee will evaluate the Competition Tasks performed by the Entrants and will select among the Entrants 2 (in words: two) Winners, who, in the opinion of the Competition Committee, will perform the Competition Task in the most attractive, original and creative manner. 
  3. The following prizes will be awarded to the winners of the Competition:
    • Prize for one participant - a floor mat in the colour of your choice 
  4. The prizes are exempt from personal income tax under Article 21(1)(68) of the PIT Act. 
  5. The Commission will finalise the selection of the Winners no later than 15.05.2024
  6. The Winners of the Competition will be informed of their Prize by posting a list of the Winners indicating their profile names (accounts) on the Organizer's profile on Instagram https://www.instagram.com/antilda_accessories no later than 15.05.2024
  7. Information on winning the Competition will be sent to the Winners in a private message on Instagram.
  8. In order to receive the Prize, the Winner will have to provide the Organizer, within 14 days from the Organizer's sending an e-mail to kontakt@antilda.com, with the information necessary to receive the Prize, including in particular: first name, surname, e-mail address and correspondence address in the territory of the Republic of Poland. 
  9. In the event that the Winner fails to provide the details necessary for the transfer of the Prize by the date and under the terms of paragraph 7 above, the Selection Committee shall select the next Participant to receive the Prize.
  10. The Organiser shall not be liable for failure to deliver the Prize to the Participant if the failure to deliver the Prize was solely due to the Participant's failure to provide the data required for delivery of the Prize or the provision of incorrect or inconsistent data.
  11. Each Prize shall be sent once by the Organiser to the address specified by the Winner within the territory of the Republic of Poland within 7 days from the date of sending by the Winner in reply to the information notifying of the awarding of the Prize all details enabling dispatch of the Prize or to the email address.
  12. The founder of the Prizes is the Organiser. 
  13. The winner may not transfer the rights to the prize awarded to a third party. 
  14. The Winner has the option to waive his/her right to the Prize by submitting a declaration to the Organiser in writing.
  15. You can only receive a Prize 1 (in words: one) time in the Competition.
  16. The prize will be sent to the Participant at the Organiser's expense. 
  17. The Participant shall not be entitled to request the conversion of the Prize into a cash prize.

§5 Personal data

  1. The personal data of the Participants is administered by the Organiser. Contact with the Organiser is possible by post at Drawska 10/47, 02-202 Warsaw and by e-mail at kontakt@antilda.pl.
  2. The basis for the processing of personal data is Article 6(1)(a) RODO the consent of Participants to participate in the Competition and Article 6(1)(f) i.e. the legitimate interest of the administrator, in particular with regard to the recognition of complaints and the assertion of claims.
  3. The Participants' personal data will be processed to the extent and for the purpose necessary to conduct the Competition, select the Winners, deal with any complaints and, in the case of the Winners, also to notify them of the award of the Prize, to release the Prize.
  4. The provision of personal data is voluntary, however, it is a condition for the delivery of the Prizes to the Winners or for the lodging of a complaint, as regards identification and address data. 
  5. Personal data will be retained for the duration of the Competition and, after its completion, until the statute of limitations for possible claims or the expiry of the obligation to retain data under the law, but no longer than 5 years, from the end of the calendar year in which the Competition was held.
  6. The Organiser shall exercise the rights of data subjects, i.e. access to the content of their data and the right to rectification, erasure, restriction of processing, the right to data portability.
  7. Where personal data is processed on the basis of consent, the Participant has the right to withdraw consent, at any time, and the withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal. Withdrawal of consent requires electronic notification to the email address kontakt@antilda.com
  8. The recipients of the data are: entities providing hosting services, postal services, entities with which the Organiser cooperates within the framework of accounting and tax services, public authorities on the basis and within the limits of the law, in particular such as KAS, law enforcement agencies. 
  9. Personal data is not processed automatically and subject to profiling. 

§6 Complaints

  1. Participants of the Competition have the right to submit a written complaint with the annotation "Complaint: what other idea do you have for the use of Antilda floor mat ? "to the e-mail address kontakt@antilda.com or the mailing address Drawska 10/47, 02-202, related to the course of the Competition during its duration, as well as up to 14 days after the end of the Competition.
  2. The letter containing the complaint should indicate the name of the Participant and the correspondence address to which a reply to the complaint will be sent.
  3. The Organiser will respond to the Participant's complaint within 14 days by registered letter sent to the address specified in the letter containing the complaint.
  4. Negative consideration by the Organiser of a Participant's complaint does not exclude the Participant's right to pursue his/her claims under generally applicable laws, including through court proceedings.

§7 Final provisions and technical information.

  1. The regulations enter into force on 8.05.2024 
  2. The Competition is not a promotional lottery within the meaning of Art. 2, sec. 1, item. 9 of the Act on Games and Betting of 29.07.1992 (Journal of Laws of 2004, No. 4, item 27, as amended) and is not subject to the rules contained in the aforementioned Act and its implementing regulations.
  3. The Competition Organiser is not responsible for the inability of a potential Entrant to submit a completed Competition Task for reasons solely attributable to the Entrant.
  4. The Rules of the Competition are made available during the duration of the Competition via the public ICT network Internet at URL: www.antilda.com and at the registered office of the Organiser.
  5. The organiser undertakes to make every effort to resolve amicably any disputes that may arise in connection with the conduct of the Competition. 
  6. The competent court for disputes shall be the court of local and material jurisdiction in accordance with the law.
  7. This Competition is in no way organised, sponsored, conducted or endorsed by or associated with Instagram. 
  8. The entity solely responsible for the conduct of the Competition is the Organiser, and Participants agree to indemnify Instagram against any liability that may arise in connection with the organisation of the Competition.  
  9. A change to the Terms and Conditions requires publication and informing Participants of the changes made by the Organiser. Amendments can only be made for reasons of adapting the Rules and Regulations to the norms of the law in force.
